General Terms and Conditions
Valid from: 13.05.2026
By registering for a course, parents, legal guardians or participants confirm that they have read and accepted these General Terms and Conditions.
1. Course Registration
Registration takes place via the Swim Swift website.
Registration is binding once the registration form has been submitted and payment has been successfully completed.
A course place is only reserved once payment has been successfully completed.
Registrations are processed subject to availability, suitability of the participant’s age and swimming level, and successful payment of the course fee.
Each course must be booked separately. Follow-up courses, new trimesters or higher-level courses are not booked automatically. A new registration and payment are required for each course period.
Children already attending a current Swim Swift course may be given priority when registering for the following course period, but a place is only reserved once the new registration and payment have been completed.
If a course has too few registrations, Swim Swift may postpone, merge or cancel the course. Affected participants will be informed by e-mail.
If a course is fully booked, Swim Swift may maintain a waiting list.
Swim Swift reserves the right to refuse or suggest changes to a registration if the selected course is not suitable for the participant’s age, level or safety needs.
Swim Swift may combine different levels or course groups where appropriate. In such cases, Swim Swift ensures that the group remains suitable for the age, level and safety of the participants.
2. Course Information
After registration and payment, the booking is binding. Swim Swift does not send a separate legal course confirmation.
Approximately one week before the course starts, Swim Swift sends an informative e-mail with additional course details.
This e-mail may include, for example:
exact meeting point
access information
pool or facility rules
what to bring
hygiene requirements
instructor information, where applicable
other practical course details
Parents, legal guardians or participants are responsible for providing a correct e-mail address and checking their inbox, including spam or junk folders.
3. Course Fees and Payment
Course fees are paid in advance during the online registration process.
Payment is processed through Stripe or another payment provider made available by Swim Swift.
If payment is not successfully completed, the registration is not valid and no course place is reserved.
Any payment processing may be subject to the terms and privacy information of the relevant payment provider.
4. Cancellation and Refunds
Registrations are binding.
Cancellation by the customer is not possible.
Course fees are not refunded if a participant cannot attend the course.
No refunds, credits, price reductions, replacement lessons or make-up lessons are granted in connection with customer cancellation, non-attendance, scheduling conflicts, holidays, school events, private appointments, illness, accident or other personal reasons.
Non-attendance does not entitle the participant to any refund, credit, price reduction, replacement lesson or other compensation.
Cash payouts are excluded.
5. Absences and Missed Lessons
Missed lessons cannot be rescheduled or made up.
Missed lessons do not entitle participants to a refund, credit, price reduction, replacement lesson or make-up lesson.
This applies regardless of the reason for the absence, including illness, accident, holidays, school events, private appointments, scheduling conflicts or other personal reasons.
6. Changes or Cancellation by Swim Swift
Swim Swift may cancel, postpone, merge or adapt courses for organisational, operational or safety reasons.
This may include, for example:
insufficient number of participants
illness or absence of an instructor
pool closures
technical problems at the pool
official orders
safety concerns
events outside Swim Swift’s control
If a course is cancelled by Swim Swift before it begins and no suitable alternative is offered, the course fee will be refunded.
If Swim Swift postpones or adapts a course, Swim Swift will inform affected participants by e-mail.
If an instructor is unavailable, Swim Swift may provide a substitute instructor without prior notice.
7. Force Majeure and Pool Closures
Swim Swift uses rented swimming facilities and does not control the operation or availability of these facilities.
If courses or lessons cannot take place due to circumstances outside Swim Swift’s control, including closure of the swimming facility, technical failures, cleaning, natural events, official orders, operational disruptions, safety concerns or other force majeure events, there is no entitlement to a refund, credit, price reduction, replacement lesson or compensation.
Swim Swift may voluntarily offer an alternative solution, such as an adjusted course schedule, replacement lesson or credit. Such alternatives are offered at Swim Swift’s sole discretion.
8. Safety and Responsibility
Parents, legal guardians or accompanying persons are fully responsible for their children before and after the swimming lesson.
Swim Swift instructors are responsible for registered participants only during the official lesson time.
Swim Swift assumes no responsibility for children before the start of the lesson or after the lesson has ended.
The instructor’s duty of supervision ends when the children are dismissed at the end of the lesson.
Children must arrive at the agreed meeting point on time, changed, showered and ready for the lesson.
Children should be at the poolside or agreed meeting point 5 minutes before the lesson starts, unless Swim Swift communicates otherwise.
Parents or legal guardians must inform Swim Swift in advance about any medical conditions, allergies, disabilities, special needs, anxiety, behavioural challenges or other safety-relevant information.
Swim Swift may refuse participation if important safety information is missing or if participation would create an unreasonable safety risk for the child, other participants or instructors.
9. Swimming Facilities
Swim Swift lessons take place in selected swimming facilities, including school swimming facilities rented from the Sportamt Zürich.
Access to the swimming facility is included in the course fee for registered participants during the allocated lesson time.
The swimming facility may only be used by current registered participants and only during the allocated course time.
Participants may not swim before or after the lesson unless expressly permitted by Swim Swift or the facility operator.
Participants and accompanying persons must follow the rules of the respective facility, the hygiene and safety requirements, and the instructions of Swim Swift staff.
Swim Swift may exclude participants or accompanying persons from the lesson or facility if safety, hygiene or facility rules are not followed.
10. Hygiene and Pool Rules
Thorough showering before the lesson is mandatory.
Please ensure that your child uses the toilet before the lesson starts. During the lesson, toilet visits may not always be possible.
Food and drinks are not permitted in the pool area or changing rooms unless expressly allowed by the facility.
Changing rooms, showers and pool areas may only be entered barefoot or with clean flip-flops or pool shoes.
Outdoor shoes are strictly prohibited in changing rooms, showers and pool areas where barefoot rules apply.
Prams and pushchairs may not be taken into changing rooms, showers or pool areas unless expressly permitted by the facility.
For safety reasons, running, pushing, rough behaviour or unsafe conduct in the pool area is not permitted.
11. Illness or Absence of the Instructor
If an instructor is ill or absent, Swim Swift may provide a substitute instructor without prior notice.
If no substitute instructor is available, Swim Swift may cancel or postpone the lesson.
If Swim Swift cancels a lesson due to instructor absence, Swim Swift may offer a replacement lesson, credit or other suitable solution.
12. Photography and Filming
Photography and filming in the swimming facility are strictly prohibited unless expressly authorised by Swim Swift and the facility operator.
Swim Swift does not publish photos or videos of participants for marketing or public communication purposes without prior consent.
For children, consent must be given by a parent or legal guardian.
Consent may be withdrawn at any time with effect for the future.
13. Swimming Materials and Equipment
Appropriate swimwear is mandatory.
Swimming aids such as floaties, arm bands or swim vests are generally not permitted during lessons unless expressly allowed by Swim Swift.
Swimming goggles may be used from Level 3 onward.
In exceptional cases, swimming goggles or other aids may be allowed earlier with prior agreement from Swim Swift.
Swim Swift may provide or recommend suitable learning materials depending on the course level.
14. Insurance and Liability
Participation in swimming lessons is at the participant’s own risk.
Parents, legal guardians or participants are responsible for adequate insurance coverage, including accident, health, liability and cancellation insurance.
Swim Swift is not liable for accidents or incidents occurring before or after the swimming lesson, including in changing rooms, showers, corridors, waiting areas or other facility areas outside the actual lesson time.
Swim Swift is not liable for loss, theft or damage to personal belongings.
Swim Swift is liable only for damages caused by intentional or grossly negligent conduct by Swim Swift. Any further liability is excluded to the extent permitted by law.
15. Data Protection
Swim Swift processes personal data in connection with registrations, bookings, communication, course organisation, payment processing and the safe provision of swimming lessons.
Further information is available in Swim Swift’s Privacy Policy published on the website.
16. Applicable Law and Jurisdiction
Swiss law applies exclusively.
The place of jurisdiction is Dübendorf, Switzerland, unless another mandatory place of jurisdiction applies.
17. Final Provisions
If any provision of these Terms of Service is or becomes invalid, the validity of the remaining provisions remains unaffected.
Swim Swift may amend these Terms of Service at any time.
The version published on the website at the time of registration applies.
